Peaceful protest without arms is a fundamental right as per this constitutional article. However, if any law prohibits such assembly then it becomes unconstitutional. The word law doesn't apply to any executive order. An order by Prime Minister is not the law, its only and executive order. Law means a statute passed by the Parliament.
Hence if no law is there to prevent people from gathering at a certain place, then the protest is a fundamental right. Protests of Pakistan Awami Tehreek and Pakistan Tahreek-e-Insaf are absolutely within the domain of this article. They are lawful and constitutional as they are peaceful and without arms.
