Answer. Khula under the provisions of Dissolution of Muslim Marriages Act 1939. I can help you out from drafting the case to getting the Khula decree from the family court. Your cousin can file case anywhere in Pakistan where she has an address and she has to appear in the court personally at the time of pre-trial reconciliation proceedings if they take place and at the time of evidence. A khula case usually takes between three to six months in the proceedings depending upon various factors. Also email me the Nikah Nama because if she has the right of Talaq-e-Tafweez in the Nikah Nama than that can simplify things for her.

  1. can khula be obtained thorough power of attorney if the reason for not coming to court is mentioned as that the lady is pardanashin but in actual she is not a pardanashin and has went abroad to avoid coming to the courts does it make the reason invalid for attorney and is their any precedent that khula can be granted on power of attorney.
