Inheritance under Shia Law


Inheritance under Shia law, 3 classes of heirs. 2000 SCJ 278; see 2006 YLR 1657; 2007 SCJ 676; PLJ 2006 Lah. 8.
Widow of Shia deceased entitled to ¼ share of immovable property left by deceased husband. 2007 YLR 3301; PLD 2008 Kar. 167; see 2008 Civ. 633.
Childless widow in Shia law entitled to inheritance only in movable property. PLD 2008 Lah. 167; NLR 2008 Civ. 633; 2007 CLC 1840.
Two sisters succeed to whole property. KLR 2009 CC 2.
Under Shia Law of Inheritance consanguine brother would not be entitled to claim inheritance. NLR 2004 SCJ 512.

Widow under Fiqah Jafria is not entitled to get share in land but only in movable. PLJ 2008 Lah. 696; 2008 Civ. 633; PLD 1972 SC 31 relied.
