The Process of Hindu Divorce in Pakistan

There is no concept of Divorce in Hinduism as far as scripture is concerned. The old Holy books of Hinduism are against divorce and second marriage of Hindus. Once the bride and groom take 7 circles together, they enter into a relationship that lasts for 7 lives according to Hindu faith.

However, an exception to this general concept is present in Hindu community since time immemorial. There have been divorces in Hindus in certain areas as per their traditions. When a wife is disobedient or if the husband is of immoral character, divorce in possible in Hindus in some areas traditionally.

India is the country from where Hinduism originated and majority of Hindus are living there. In 1955 a legislation was made in India which is known as the Hindu Divorce Act, 1955. According to this law Hindu divorce is possible on many grounds. Some of these include adultery, polygamy, desertion, non payment of maintenance, etc.

As far as Pakistan is concerned, there is almost no Hindu legislation present in the country. There is no Hindu Divorce law yet made in Pakistan. However, courts in Pakistan recognize that citizens have rights to get their litigation decided according to their faiths.

Hindu Divorce Cases are filed in the courts of senior civil judges in Pakistan. They are proceeded as civil suits and decided eventually with a decree and judgment. References in such cases can be made from Hindu related legislation from around the world.
