Mubarat Deed can be made by one party

The Deed of Mubarat or Mubarat Deed can be drafted or prepared by one party and the other has to sign and endorse it. Mubarat Deed is made on a Stamp Paper which require endorsement by both parties at the time of execution. Since it is an agreement for mutual divorce, the stamp paper can be issued on the endorcement of either of the parties.

A Mubarat Deed has no legal value unless its executed by both the parties. Further its value is dependent upon the corroboration of both the parties at the time of recording of their respective statements. If any party denies execution of mubarat deed before the chairman arbitration/union council at the time of recording of statement, such Mubarat Deed may be of no avail at later stage.

Divorce is not possible during pregnancy

When a girl is pregnant, divorce or khula is not possible. It is a protection given to a mother to be from Allah. A case for dissolution of marriage has no importance if the girl is pregnant because Khula or divorce both are not possible during pregnancy.

If a husband pronounces divorce to his wife during her pregnancy, that divorce becomes effective after the delivery of child. The iddat of wife starts after delivery of child. The divorce in that concludes after 90 days of delivery of child if no reconciliation takes place in between the parties.

Even if a husband pronounces divorce hundred times during pregnancy, it doesn't become divorce during the tenure of pregnancy.

Reasons of Increase in Divorces in Pakistan

There are many reasons for increase in divorces in Pakistan in recent years. Many people blame women for such increase which is not the sole reason of increase in divorces.

Being an experienced lawyer dealing in family cases for more than ten years, i would say that the main reason is the increase in awareness. In old times when a girl used to get married, she used to suffer at the hands of family of her husband till her death. Family of bride never used to interfere in her marital life no matter whatever she used to face.

Now the trends have changed. Girls are educated these days. They cannot tolerate beating and abuse at the hands of their husbands and their families. Similarly their families mostly take stand for them in cases of domestic violence and domestic abuse.

Awareness of law is also increasing in the society. Social media has opened corridors of opportunities also for divorcing couples. Some of these factors mainly contribute in the increase in divorce cases in Pakistan.

Divorce Process is of three months in Pakistan

According to the provisions of section 7 and 8 of Muslim Family Laws Ordinance 1961 divorce process is of three months. When divorce is pronounced, the documents have to be submitted in the relevant Arbitration/Union Council.

After that notices are served. On the dates reconciliation proceedings are conducted. There are generally three reconciliation proceedings in a divorce case. Each reconciliation proceeding is conducted once a month.

On the failure of reconciliation proceedings and on the expiry of 90 days, divorce becomes final and finally certificate of divorce is issued by the same council.
