Judicial Review in the Supreme Court

Review petition is filed when an aggrieved party wishes to get the whole case re-heard by the same court. This often happens when there is no forum available once judgment is passed in a matter by a court of proper jurisdiction. For example the Supreme Court in Pakistan is the ultimate authority in deciding any matter. There is no forum of appeal against the decision of Supreme Court of Pakistan. In such cases judicial review comes very handy.

The decision of Supreme Court in any matter can be challenged in the Supreme Court through a Review Petition under article 188 of the Constitution of Islamic Republic of Pakistan 1973. The same Article is reproduced below:-


188Review of Judgments or Orders by the Supreme Court.
The Supreme Court shall have power, subject to the provisions of any Act of  414[Majlis-e-Shoora (Parliament)] 414 and of any rules made by the Supreme Court, to review any judgment pronounced or any order made by it.
